TERMS AND CONDITIONS AGREEMENT BETWEEN THE ROMAN GUY INC AND ITS USERS/CLIENTS

Precursor

The Roman Guy is a customer service and experience based company.  Terms and conditions tend to be full of jargon and tough language and ours probably is not any exception. In the end, we want you to have the best possible experience and will try our provide you with such.  We highly recommend you read over these terms and conditions in their entirety.  One of the most relevant areas is section 6 – 6.3.  This is regarding cancelations and refunds.  Please look it over, understand it and ask questions if need be.  Thanks for considering us!

1. DEFINITIONS:

Terms and Conditions of use –refer to the policy & rules which regulate the use of this site.

User – refers to any person, you, who enter, read, and/or uses this site and all that it has to offer.

Seller – refers to The Roman Guy Inc. and those of which are employed by The Roman Guy Inc. Service Provider – refers to any person not employed directly by The Roman Guy Inc. that provides services under the guidance of The Roman Guy Inc. May also be referred to as a 3rd Party or 3rd Party Service Provider.

Website (site)– refers toto TheRomanGuy.com website and any links available from or within the website, but does not include any external websites or links to external websites not belonging .to or controlled by The Roman Guy Inc or a related The Roman Guy Inc company.

Material/s – refers to physical material and items contained in this site that can be extracted. i.e. HTML, photographs, maps, software, films, emails, video.

Services – refers to the products and services offered within this website; tangible or intangible.

TRG – The Roman Guy Inc

Private Tours – A tour that is conducted privately without outside participants.  This means that it is simply your group, however large or small, and the tour guide.

Small Group Tour – A tour that has members from multiple parties and a tour guide.  Group sizes vary as advertised on our website, but basically your group may be accompanied by others.

Museum Tickets/admissions – refers to the fee charged in order to enter museums, archeological sites and/or desired historical sites of importance.

Booking confirmation – is a confirmation sent via email or fax that confirms services have been confirmed and reserved.

Reasonable Action – any action that remains within the laws of the country in which the action is taken and does not end in a financial loss for The Roman Guy Inc or any of its associates.

Clients – users that have accepted terms & agreements of The Roman Guy Inc. and have paid or eventually will pay for services. This agreement will either be made after the booking process on our site by purchasing our travel products or with a member of our travel planning team via email.

Drivers – refers to service professionals that operate cars, vans, helicopters, boats, buses and/or any vehicle powered by an energy source.

Trip Planning – Services offered by The Roman Guy Inc at a fee which help with the planning of your vacation, including hotel reservations, land transfers, transport bookings, restaurant bookings, extraordinary requests and planning hours.

Trip – Travel Planning planned by The Roman Guy

City Tours — All tours available on TRG website, excluding guided vacations.

Double Occupancy – Hotel room shared by two persons.

Land Rates – Does not include airfare.

Guided Vacations — All pre-packaged vacations sold on TRG website under the Guided Vacations tab in the main navigation menu.

2. YOUR CONTRACT WITH THE ROMAN GUY INC.

When you make a booking with “The Roman Guy Inc” you undertake that you have the authority to accept and do accept these booking conditions on behalf of yourself and your party. These conditions in conjunction with the information set out in our website form the entire agreement between yourself and TRG. TRG reserves the right to change these terms & conditions without notice.

3. PRICES

Prices are fixed at the time of booking and generally will not be subject to surcharges. The only exception to this will be an increase in our costs arising as a result of any government action including but not limited to new or increases such as VAT. Museum tickets/admissions are also subject to change without notice due to the addition and removal of Exhibitions by the museums.  This is an extremely rare occurrence.

Prices may change with the usage of promo codes as detailed in section 4.

3.1 TRG GUIDED VACATIONS PRICES

All prices for multi-city over night vacation are Land Rates. We refer to this as “Guided Vacations.”  It is not “Trip Planning.” All prices are per person for double occupancy unless single occupancy is requested prior to checkout. Website prices are subject to change at any time prior to the receipt of a deposit at the discretion of management. For the most current prices please visit our website. Land Rates are guaranteed non-changeable at time of deposit.

4. Promo Codes

Promo codes and special “offers” are subject to the terms of each offer.  This meaning that the details of the offer described in each place of advertisement.  They are also subject to the below terms.

a) You cannot use two promo codes at once in any situation.  We also do not allow a promo code to be used with our “deals” or previously discounted tours.

b) Promo codes are valid only for their advertised discount. If an additional amount is discounted due to technical issues with our website or human error, TRG has the right to request additional payment to cover the difference. If the client refused to cover the difference, TRG will amicably cancel the tour and refund 100% of initial payment.

c) Promo codes DO NOT work on the Colosseum Dungeons tour in any capacity.  The tour is not discounted due to it’s high cost to run. They are also not guaranteed to work on any specific tour.

d) Promo codes are usable only for the persons that they are offered to if received via email, unless explicitly written otherwise.  Promo codes are not a “right” nor an “entitlement”.  They are usable only as described and are not applicable to past purchases.

5. CHANGES BY CLIENTS

Changes must be requested at least 72 hours prior to your confirmed services and can not be guaranteed – they are based on availability. TRG staff will do their absolute utmost to assist clients with any changes. The first change will be free of charge. For any future changes, we will need to apply and administrative fee of $5 per person, per tour. If you are changing a tour time/date to purchase another tour from us the fee will be waived.

If you made a mistake with your booking and notify us within 48 hours, we will change your booking, pending availability, free of charge.

These Article 5 Terms & Conditions do not apply to the purchase of Trip Planning or Guided Vacations. Terms & Conditions regarding Trip Planning Changes made by buyers can be found in Article 9 below. For more Terms & Conditions on Guided Vacations, see Article 6.2.

6. CANCELLATIONS BY CLIENTS ON TOURS

The Roman Guy offers a 95% refund on cancellations made more than 72 hours prior to your tour taking place. Cancellations made within 72 hours of your tour taking place cannot be refunded but we will do our best to accommodate you on another tour or date, pending availability. For small group tours, we will do our best to re-schedule you on another tour for as much as 40% of the original cost, but once again this is subject to availability.  For private tours, customers will be asked to pay up to 60% of the original tour cost. The cost we ask varies per tour, but in general we only charge you for any additional costs that we incur such as tickets.  We have no intention of profiting from disruptions to your vacation.

Due to extremely strict slot times for entry into sites, we recommend you to show up 15 minutes before the scheduled meeting time on your voucher. The group leaves exactly at the scheduled meeting time. If you show up late or cannot find the meeting point, for any reason, you will not be granted a refund. For most tours, it is not logistically possible to join the group after it has started.

It is highly recommended that you carry a mobile device with you to the meeting point.  Use the phone number and email address of that device when booking.  If you are late or lost we will do our best to contact you to help.  If we successfully contact you and you still cannot get to the meeting point in time to enter with our group, you will not be granted a refund.

The first paragraph in the above Article 6 Terms & Conditions do not apply to the purchase of Trip Planning or Guided Vacations. Terms & Conditions regarding Trip Planning Cancellations can be found in Article 6.3 and 8. Terms & Conditions regarding Guided Vacation Cancellations can be found in Article 6.2.

6.1 CANCELLATION DUE TO PLANES, TRAINS OR AUTOMOBILE

As stated above, we do not refund clients who do not show up on time for tours. This includes, but is not limited to, tardiness due to flight or train cancellations, delays or issues caused by traffic or congestion.  In general, we do not refund anyone cancelling within 72 hours of the tour start time.

To protect you from this portion of our cancelation policy, we recommend the purchase of travel insurance.  We recommend a particular policy, but you are welcome to shop around.  Be sure to ask a representative if the insurance policy covers losses due to delays and cancellations.  We also recommend getting that in writing. The Roman Guy does not take responsibility if a policy, even the one we recommend, does not cover any losses due to delays. Each traveler should be diligent when selecting a policy to ensure it covers trip disruptions.

In the case of a delay, we recommend contacting us as soon as you know you will be late.  The earlier we know, the more we can do for you.

As mentioned above, for small group tours, we will do our best to re-schedule you on another tour for as much as 40% of the original cost, but once again this is subject to availability.  For private tours, customers will be asked to pay up to 60% of the original tour cost.

6.2 TRG GUIDED VACATIONS CANCELLATIONS

For the purpose of TRG’s Guided Vacations cancellation policy, your departure date is included into the total amount of days.

TRG reserves the right to collect the following cancellation charges under any circumstance except with the purchase of our Trip Cancellation Waiver.

More than 60 days prior to departure: loss of non-refundable deposit ($250 per person)

60 to 14 days prior to departure: 50% of total price including deposit

14 to 1 day prior to departure: 75% of total price including deposit

Day of departure and after: 100% of total price including deposit

For example, if your trip leaves on July 1st you will only lose your deposit up until May 1st (61 days prior to the departure date). On May 2nd (60 days prior) you will lose 50% of the total price of your package, including your deposit. On June 17th (14 days prior) you will loose 75% of the total price of the package, including your deposit. On July 1st, your departure date, you will be responsible for the loss of the full cost of your vacation package, including your deposit.

6.3 TRIP CANCELLATION WAIVER

Purchase of a trip cancellation waiver guarantees full reimbursement to each person that purchased the trip cancellation waiver, for any reason up until the day prior to departure.

Cancellation on the day of departure, labeled DAY 1, will be subject to 100% fee of total price including deposit and trip waiver cancellation. Cancellation of your trip must be put into writing and emailed to info@theromanguy.com prior to 11:59pm US Eastern Time the day before your departure.

7. TRIP PLANNING INITIAL FEE

At the initiation of planning a trip TRG reserves the right to request a refundable Trip Planning deposit of 200 euro. This fee is to assess the seriousness of a clients intentions to travel. TRG will offer a full refund of this deposit at any time and for any reason prior to the travel planning confirmation which is received upon the client’s payment of a second deposit. Upon payment of the second deposit, all fees assessed are subject to our cancellation policy detailed in Article 8 below. TRG reserves the right to not confirm or make any necessary reservations prior to the payment of the second deposit.

8. CANCELLATION POLICY FOR TRIP PLANNING

TRG reserves the right to charge a 25% cancellation fee, taken from the buyers deposit, for any trip cancelled 45 days prior to the arrival date in Italy. TRG reserves the right to charge a 50% cancelation fee, taken from the buyers deposit, for any trip cancelled 15 days prior to the arrival date in Italy. TRG reserves the right to withhold the full cost of the vacation for any trip cancelled 72 hours before the time of arrival in Italy.

9. TRIP PLANNING AMENDMENTS BY BUYERS

Trip planning is a service administered prior to arrival of your desired destination therefore the service is completed upon payment. Once any form of payment is made, TRG will not offer a refund to the Trip Planning fee in your invoice. If you choose to amend or change your reservations TRG as a service will do its best to make it happen without additional charges, but we reserve the right to assess amendments as cancellations if coinciding cancellation policies held by hotels or service providers conflict with those of TRG. All other fees are subject to a 95% refund less admissions with the exception of 3rd party affiliates with conflicting terms and conditions as stated above.

10. CHANGES AND CANCELLATIONS BY THE ROMAN GUY INC

TRG reserves the right to change the start time, date, meeting point of any tour or service you book through TRG. In the case you, the user, are dissatisfied with the change offered, TRG will offer its sincerest apology and a full refund.

11. PAYMENTS

11.1 TRG CITY TOURS (PRIVATE AND SMALL GROUP TOURS)

TRG accepts the following methods of payment: Visa, MasterCard, American Express, Discover & Paypal. TRG will NOT charge an additional fee for the booking of private and semi-private tours booked directly through the website without the use of Trip Planning. As mentioned previously TRG offers a 95% refund (less tickets) up to 72 hour prior to services. TRG reserves the right to deny any refund request submitted less than 72hours prior to services. As stated prior, all refunds must be made in writing and submitted via e-mail or fax. All faxes will be accompanied by an email address and email confirmation will be given to assure receipt of fax. Complete refunds can be offered only by the discretion of management.

11.2 TRG GUIDED VACATIONS

We require a 10% non-refundable deposit at the time of booking to secure your reservation. If you purchase our trip cancellation waiver you must do so at time of purchase, in addition to your deposit. Purchasing our waiver guarantees a full refund of your deposit and all payments made to The Roman Guy Inc, except your waiver fee, up until the day of departure. The waiver guarantee is a per person fee that is only valid for those who purchase in combination with deposit payment. Your full balance is due 60 days prior to departure. TRG accepts the following methods of payment: Visa, MasterCard & American Express or by sending us a personal check or money order.

11.3 TRIP PLANNING

Once you have finalized your plans for your vacation, our trip planning payment plan is the following:

– Non refundable 20% deposit to confirm the trip

– Full payment 60 days prior if not on recurring billing with credit card

– Full payment 30 days prior if on recurring billing with credit card

12. INJURY, LOSS OR DAMAGES AGREEMENT BETWEEN USERS & TRG

TRG is not responsible for any loss, injury or damage that occurs during the use of its services i.e. robbery, car crash, illness, acts of terrorism, spontaneous gladiatorial events and/or the chapter Revelations from the bible.

TRG is not responsible for the actions of its 3rd party service providers such as drivers or guides. TRG will however assure that all drivers have the proper insurance policy and licensing for transporting tourists in their locality.

13. TRAVEL INSURANCE

TRG advises all clients to purchase travel insurance in every circumstance possible. TRG may at times recommend an insurance provider, but is not a certified seller of insurance and does not take responsibility for future disputes with any recommended seller of travel insurance. TRG does assure users that it will not recommend any travel insurance provider that has, as far as TRG is aware, caused problems for previous TRG clients.

If any employee of TRG advises any user or client against the purchase of Travel Insurance they will be subject to termination immediately without compensation.

14. SPECIAL ASSISTANCE

Travelers needing special assistance must report disability or allergy to TRG at the time of booking. TRG will make every effort to accommodate all travelers but not all historical sites are equipped for those who have walking difficulties. Travelers should know that handicap access is not required in Italy such as in the United States (Americans with Disabilities Act). Some sights, such as The Roman Forum, will be difficult to access for those in wheel chairs.

15. BAGGAGE DISCLAIMER

TRG cannot be responsible for lost, stolen or damage personal items during tours. TRG partners with the best transport providers, attentive guides and service providers, but it is the responsibility of each participant to keep a watchful eye on their personal effects. TRG always recommends that travelers have adequate insurance to cover these issues.

16. HOLIDAY OR MUSEUM CLOSURES

TRG has done all adequate research and planning to be sure its clients are able to do all of the tours scheduled on TRG website, but we cannot be responsible for strikes within Italy. If there is a museum or archeological site closure due to strike, TRG cannot take responsibility as there is no way to know in advance. We will try our best to reschedule any affected tours, but successful rescheduling to meet client needs cannot be guaranteed. Most museums in Italy reserve the right to close at an instance notice for any reason they deem necessary. TRG cannot be responsible for choices made by archeological site, museums or church management.

17. YOUTH DISCLAIMER

Any minor child under the age of majority who participates in a TRG Tour, TRG GUIDED Vacations or TRG service, must be accompanied by an adult and supervised by an adult during the entire length of the city tour/vacation package/service. TRG, or any person employed by TRG, cannot take responsibility for minor children during the length of a TRG city tour/vacation package/service.

17.1 TRG CITY TOURS

It is highly recommend that persons needing special assistance book a TRG private tour with a companion that is physically able and completely responsible for providing assistance. Although TRG will do as much as possible to accommodate those with disabilities, TRG cannot be responsible for personal assistance and, in order to ensure you get the most out of your experience, it is suggested that you book a private tour to give you flexibility with times and to ensure the best tour route is planned in advance to meet your needs.

17.2 TRG GUIDED VACATIONS

It is highly recommend that persons needing special assistance book with a companion that is physically able and completely responsible for providing assistance. TRG will do as much as possible to accommodate those with disabilities without inconveniencing others on tour, but cannot be responsible for personal assistance. It is required that those booking with a walking or movement disability are accompanied by a capable assistant.

The information contained in this website is for general information purposes only. The information is provided by The Roman Guy Inc and, while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

19. PRIVACY POLICY

The Roman Guy Inc (TRG) is not in the business of selling personal information, content, data, or anything that is not property of TRG.  TRG ensures the user & client that we will not intentionally sell your private data that may be collected intentionally or unintentionally by TRG.

The user is subject to these Terms & Conditions immediately upon entering our site.
